At its core, sexual assault in California is any unwanted sexual contact or behavior that happens without clear, informed consent. This includes situations where a person can't clearly agree to what's happening, such as when they're unconscious, under the influence of drugs or alcohol, physically unable to respond, or otherwise incapacitated.
Acts that may be classified as sexual assault under California law include:
Sexual assault doesn’t always involve physical violence or force. In many cases, the harm comes from manipulation, pressure, threats, or emotional control. A person may feel too scared, ashamed, or overwhelmed to say no, but that doesn’t mean they agreed.
It’s important to understand that force isn’t just physical. Perpetrators may use guilt, intimidation, or fear to control someone, and those actions are just as serious. These non-physical forms of coercion can leave deep emotional scars and are fully recognized under California law as forms of sexual assault.
While Carlsbad is recognized as one of the top 25 safest cities in California based on overall crime rates, this designation does not mean the community is immune to sexual assault.
It is important to understand that sexual violence often occurs behind closed doors and can take many forms beyond what is typically reported as violent crime, such as coercion, exploitation, and unwanted sexual contact. Safety rankings based on broad crime data do not always reflect the hidden, personal nature of these offenses.
Regional trends in Carlsbad and San Diego County offer important insights into the ongoing challenges of sexual assault we face in our community. By understanding these numbers, we can better support survivors and work toward change.
Since 1980, SANDAG has been tracking crime data for the San Diego region, providing valuable insights into local crime trends.
In 2015, California law enforcement began using a revised version of the FBI's Uniform Crime Reporting (UCR) definition of rape, which now includes male victims, sodomy, penetration with any body part or object, and incidents where force is not required. Under this definition, San Diego recorded 1,076 reported rapes in 2021 and 942 in 2022.
During the two-year period of 2021 and 2022, law enforcement agencies in San Diego County handled 4,987 reports of sexual violence. These reports included crimes such as rape, sexual battery, lewd acts on children, sodomy, and human trafficking. However, despite the large number of reports, only 7.7% (386) of these cases resulted in a conviction.

Sexual assault can take things from you in ways you never expected. It can completely disrupt your sense of safety, your health, and even your career. The effects can seep into every part of your life, sometimes surfacing long after the incident itself.
Through civil action, survivors can pursue financial recovery for a wide range of losses, including:
A recent example of this is the historic $116 million settlement our firm achieved for 103 survivors of sexual abuse at FCI Dublin, a federal women’s prison. This landmark outcome not only provided meaningful financial recovery for the survivors but also sent a powerful message. Criminal cases are brought by the state to hold the offender accountable through penalties like jail time or probation. Civil cases, on the other hand, are filed by survivors themselves to seek financial compensation for damages such as medical expenses, therapy costs, lost income, pain and suffering, and emotional distress. In California, survivors can pursue both civil and criminal actions at the same time or choose to file a civil lawsuit regardless of whether criminal charges were filed or a conviction was secured.
If you were sexually assaulted as an adult, you generally have up to 10 years from the last incident or 3 years from the date you discovered the harm caused by the assault to file a civil lawsuit. This expanded timeline applies to assaults that occurred on or after January 1, 2019. If the incident happened before that date, you may have only 3 years from when it occurred to take legal action.
In addition to the individual abuser, institutions like schools, churches, hospitals, rehab centers, or employers can be held accountable if they failed to prevent or address the abuse.
Yes. A police report is not required to file a civil lawsuit in California. Many survivors never report to law enforcement, and your credibility and case can still be valid without one.
