In California, sexual assault is any non-consensual sexual contact or behavior. It includes a range of actions where a person is forced, tricked, or manipulated into sexual activity, even without physical violence. A criminal case is handled by the state of California and focuses on whether the person who assaulted you broke the law. If found guilty, they could face jail time or other penalties. A civil lawsuit is different. It’s brought by you, and it focuses on how the assault affected your life. In a civil case, you can seek compensation for things like therapy, lost wages, and emotional pain. Even if no criminal charges are filed, you still have the right to bring a civil case.
We understand how important your privacy is. In many cases, we can file your lawsuit using a name like Jane Doe or initials, so your identity isn’t made public. While the people or institutions you're holding accountable will know who you are, your information can still be kept private in court records. It depends on when the abuse happened. If you were a child and the abuse occurred on or after January 1, 2024, there’s no deadline to file. If it happened before that, you may still have time until age 40 or within five years of realizing the harm it caused. It’s completely okay if you didn’t seek medical care right away. Many survivors need time before they’re ready to come forward, and that doesn’t take away your right to take legal action.
