Sexual Assault in Our Community: Why Vista Needs Strong Advocates

Sexual assault isn’t just something that happens far away. It has affected lives here in Vista too, such as in schools, neighborhoods, and other familiar places. That’s why we want survivors in our community to know they’re not alone and that support is available.

For example, in 2018, Vista reported over 31 rapes for every 100,000 residents. And these incidents haven’t stopped. The stories coming out of our local schools and neighborhoods make that clear.

In 2023, a 13-year-old student at Vista Innovation and Design Academy was groomed and sexually abused by her substitute teacher. Despite the warning signs, the school failed to act. That teacher later pleaded guilty to multiple felonies and was sentenced to 10 years in prison. The young survivor, through her family, is now suing the Vista Unified School District, saying it didn’t do enough to protect her.

And in 2022, another Vista resident, a longtime youth dance instructor, was arrested at his home on suspicion of sexually assaulting multiple underage students over the course of a decade. His alleged victims described abuse that began when some were just 12 or 13 years old and continued across dance studios and competitions throughout Southern California.

Sadly, abuse in positions of trust isn’t limited to schools. At Vista Village Senior Living, a caretaker used his role to abuse vulnerable elderly residents, including sexually assaulting three dependent adults and stealing from them. He later pleaded guilty to 11 felony charges, including sexual assault and elder abuse. 

These incidents are reminders that sexual assault is still happening here in Vista, often in trusted spaces like schools, studios, and workplaces.

How Long Do I Have to File a Sexual Assault Lawsuit in Vista?

In California, the time limit for filing a sexual assault lawsuit is called the "statute of limitations." 

Generally, for adult sexual assault cases, you have 10 years from the date of the assault or 3 years from the date you discover that a psychological injury or illness was caused by the assault, whichever comes later. For cases involving childhood sexual abuse, the time limits are even longer, up until the survivor’s 40th birthday or 5 years from the date the survivor discovers or reasonably should have discovered that the injury was caused by the abuse.

These deadlines are important, but you should not let the statute of limitations stop you from reaching out. It’s always best to speak with us first because you may have more time than you think.

Can It Still Be Sexual Assault If I Knew the Person Who Hurt Me?

Yes, absolutely. Most survivors actually know the person who assaulted them. It might be someone you trusted, such as a friend, coworker, partner, or family member. Just because there was a prior relationship or connection does not make what happened your fault, and it does not make it any less serious.

It is also important to understand that even if you gave consent in the past, that does not mean you gave consent every time. Consent must be given clearly and freely each time.

What If I Don't Want to Go to the Police? Can I Still File a Civil Lawsuit?

You can still file a civil lawsuit even if you don't want to go to the police or if the police investigation doesn't lead to criminal charges. Criminal cases and civil cases are separate. A civil lawsuit focuses on getting you financial compensation for your harm, and it has a different legal standard of proof than a criminal case. This means that even if there isn't a criminal conviction, you might still be successful in your civil claim.
